Hi fellas,

Please see below from MB's attorney.  I think the bylaws are pretty on the process that must be followed. Do you have time for a brief call tomorrow?

Thanks,

Seth

---------- Forwarded message --------- From: Larraine McNamara-McGraw <>; Date: Thu, Jul 20, 2017 at 8:25 PM Subject: Re: Ms. Buczynski To: Seth Goettelman <>;

Dear Seth,

Ms. Buczynski has sent me the letter she received today from Mr. Dziubek.

I have cut and pasted the letter from her email:

Dear Mary,

It has come to my attention that you have not complied with the terms of disciplinary action previously taken by the Board of Directors and set forth in its letter to you dated May 16, 2017, a copy of which is attached for your reference.  Per Article III, Section 15, Suspension and Expulsion, of the SSYC Bylaws, your membership is hereby suspended until the next regular meeting of the Board of Directors.  You have the opportunity to appear in person before the Board of Directors and present evidence on your behalf at 7:00 pm on Tuesday, July 25, 2017.  As advised with regard to the previous hearing, no recording of this hearing will be permitted. Please govern yourself accordingly.

"Section 15. Suspension and Expulsion.  The Commodore may for cause suspend any member without previous notice from active participation in Club privileges until the next regular or special meeting of the Board of Directors, at which time said Board of Directors may confirm said suspension and fix a definite period therefore not to exceed one year, or may expel such member from membership by a 2/3 vote of the Board of Directors present and voting; a member suspended by the Commodore shall have sent to him or her a written copy of the charges against him or her and shall be given an opportunity to appear in person before the Board of Directors and present evidence in his or her behalf before said Board can take any formal action against him or her."

Sincerely,

 Kenneth Dziubek

First, I must tell you that neither of us is available to attend next Tuesday's meeting, and ask that the matter be held till an appropriate time.

Moreover, Ms. Buczynski would like to resolve this amicably without having to appear in front of

up to 30 people and face further embarrassment.

Further, Ms. Buczynski has agreed to write a letter of apology. She has already agreed to destroy the tape.

Therefore, I propose that the parties meet with their counsel and with the good faith aim of resolving this once and for all.

Ms. Buczinski is missing most of the summer at this point but there is time to begin anew.

Along with the cut and paste letter, above, were several documents that were attached.  I am not sending them because I

assume you have them or can get them.  The letter from the bartender Jordan Gale is of particular interest. Ms. Buczinski

disputes the factual basis of this letter. Also, re: the July 7 complaint , Ms. Buczinski was there to deliver a check to one of the people involved in her daughter's wedding. She thought she was ok to be there (with front end suspension extended),

and did not want a confrontation with whoever it was that wrote this complaint. (Mr. Nora?)

I am only surprised that you did not get back to me to tell me about this "escalation of hostilities."  Did you know about this letter and attachments?

In any event, I would ask that,  going forward, you communicate directly with me, rather than the commodore communicating with Ms. Buczinski.  I am still hoping that this matter can be resolved amicably.  You can reach me by phone: 414-899-0883, or email.  We are willing meet with you to finalize a resolution, at your discretion.

Thanks very much.

Best,

Larraine

Dear Seth,

Attached please find the voice recording of the meeting in question.

I will be attending Ms. Buczinski's daughter Katherine's wedding and, also, going camping in the Apostle Islands July 4

until July 9.  Consequently, can we discuss resolution on July 10?

I look forward to your response.

Thanks.

Best,

Larraine
